The study, based on this book, deals with the part from the beginning of the book of selling to the end of the book of freeing slaves. twenty eight rulings have been extracted. The underlying branches became one hundred thirty seven in number. There are thirty seven regulations and the underlying branches were one hundred twenty two branches.The rulings and regulations have been studied in terms of the following:
1. It deals with the words that affect the ruling and regulation linguistically and in terminology.
2. It explained the ruling and the regulation in details.
3. It mentioned the evidences that prove the rightness of the rulings or the regulations with reference to them.
4. It mentioned the applications on the rulings and regulations.
5. It mentioned the exceptions of the rulings if possible.
The research includes: an introduction, a preface, two chapters, and a conclusion.
The introduction includes: the importance of the topic, the reasons behind selecting it, its objectives, the pertaining previous studies, the research approach and plan.
The preface deals defining with the meaning the Jurisprudence ruling and regulation and the difference between them. Then a biography of Sheikh Albahwati and his book Alrawdh Almorbei with marginal explanation of "Zad Almustanqaa".
Chapter one: It deals with the Jurisprudence rulings including eight studies in (the rules of intention, certainty and conspicuousness, the customary taboo, removing harms, trust assets, documents in Islamic jurisprudence, financial jurisprudence and a variety of other rulings.
Chapter two: Is dedicated for Jurisprudence rulings including eight studies as forth (the rulings of selling, usury, banking loaning, mortgages, credit, transference, reconsolidations, Agency, protecting a non Muslim, land seizures, redemption, depositing, royalty, Waqfs or Religious endowments, recommendation and the musts of Islam

The results:
1- The book Alrawdh Almorbei though it's small, it contains most of the Jurisprudence branches and it was the most important resource for the students of Alhanbali doctrine.
2- Imam Albahwati is an important Jurisprudence figure bin the Hanbali doctrine and one of those are interested in writing on Jurisprudence in terms of his writings and applications.
Recommendations:
1- Completeing the process of extracting the jurisprudence rulings and controls of the book (Alrawdh Almorbei )
2- Setting a dictionary for the Jurisprudence rulings mentioned in the book Alrawdh Almorbei. |
